By reserving a charter or using our Service, you consent to comply with these Terms. Should you not agree with any section of these terms, you are prohibited from using the Service.
2. Service Overview
EvenFieldRegistry offers upscale yacht charter services, which include, but aren't limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All offerings are contingent on availability and weather conditions. We maintain the authority to amend or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, you are required to:
- Be of 18 years or older
- Supply correct and thorough information
- Make payment for the necessary deposit as indicated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmed booking is only valid following the processing of your payment and our provision of written confirmation. At our discretion, we hold the right to decline service to anyone.
3.3 Availability
Charter availability is dependent on vessel availability and favorable weather. We shall put forth reasonable endeavors to honor your chosen dates and times.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and incorporate all relevant taxes unless stated otherwise. Our prices are subject to modifications without prior notice.
4.2 Payment Schedule
- Deposit: A requirement of 50% of the total charter fee at time of reservation
- Balance: Payable 48 hours in advance of the charter's departure
- Supplementary charges (if required): Payable upon the conclusion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, bank wire, and verified cheques. Payment processing is conducted through protected, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full reimbursement minus processing costs
- 24-72 hours before departure: Refund of 50%
- Fewer than 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
If challenging weather is determined by our captain, we propose to:
- Reschedule your charter at no added cost for the next viable date
- Issue a full refund if rescheduling cannot be fulfilled
5.3 Mechanical Issues
Should there be technical defects with the assigned vessel, we will seek a comparable alternative. In the absence of alternatives, a full refund shall be imparted.
6. Safety and Conduct
6.1 Safety Requirements
All passengers must:
- Heed all instructions from the crew
- Utilize the supplied safety gear when required
- Inform us of any health conditions that might influence their safety
- Stay within the designated areas onboard
6.2 Prohibited Items
The following items are strictly forbidden onboard:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excess non-alcoholic beverages (above reasonable consumption)
- Pets (unless previously authorized)
6.3 Conduct
Passengers are obligated to exhibit respectful behavior. We reserve the right to halt a charter without a refund should passenger conduct generate a safety concern or disrupt the peaceful experience of others.
7. Liability and Insurance
7.1 Our Liability
We are limited in liability to the cost paid for your charter. We are exempt from responsibility for:
- Personal harm due to passenger carelessness
- Loss or damage to personal belongings
- Indirect, consequential, or special damages
- Delays due to weather or events outside of our control
7.2 Insurance Coverage
Comprehensive marine insurance is held by us, covering our vessels and activities. Passengers bear the responsibility for their personal and travel insurance.
7.3 Assumption of Risk
By engaging in our charter services, you acknowledge the inherent risks of maritime activities and take responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
Itinerary alterations, including changes in routes or schedule, reserve the right to occur based on meteorological conditions, safety concerns, or operational needs. Every effort will be made to offer a similar alternative experience.
9. Force Majeure
We shall not be accountable for delays, cancellations, or changes instigated by factors beyond our reach, including but not restricted to:
- Extreme weather conditions
- Natural calamities
- Regulations from authorities
- Closure of ports
- Vehicular malfunctions
10. Privacy and Data Protection
Your confidential details are dealt with according to our Privacy Policy. By utilizing our service, you agree to the collection and use of your data as outlined within our Privacy Policy.
11. Intellectual Property
